These General Terms and Conditions (“Terms”) apply to all purchases made through Margery & Co. London via the website www.margeryandco.com. By placing an order, the consumer agrees to be bound by these Terms.


ARTICLE 1 – DEFINITIONS

In these Terms, the following definitions apply:

Cooling-Off Period
The statutory period during which the consumer may cancel a distance contract.

Consumer
A natural person acting for purposes wholly or mainly outside their trade, business, craft or profession.

Day
A calendar day.

Third Party
Any person other than the carrier, designated by the consumer to receive the goods.

Digital Content
Data produced and supplied in digital form.

Durable Medium
Any means which enables information to be stored in a way accessible for future reference, including email.

Right to Cancel
The consumer’s statutory right to withdraw from a distance contract.

Trader (“Margery & Co. London”)
The business offering products for sale via the website.

Distance Contract
A contract concluded between Margery & Co. London and the consumer without simultaneous physical presence.

Product
Any tangible goods offered for sale.

ARTICLE 3 – APPLICABILITY

  1. These Terms apply to all offers, orders and distance contracts between Margery & Co. London and the consumer.

  2. Prior to concluding a distance contract, these Terms are made available electronically in a durable medium.

  3. Any deviations from these Terms are only valid if expressly agreed in writing.


ARTICLE 4 – THE OFFER

  1. All offers are subject to availability and may be withdrawn or amended at any time.

  2. Product descriptions, images and specifications are provided for illustrative purposes; minor variations may occur.

  3. Obvious errors, inaccuracies or typographical mistakes do not bind Margery & Co. London.

  4. Each offer clearly states pricing, delivery information, consumer rights and cancellation conditions.


ARTICLE 5 – THE CONTRACT

  1. A contract is formed once the consumer completes the checkout process and payment has been successfully processed.

  2. An order confirmation is sent by email without undue delay.

  3. Margery & Co. London reserves the right to refuse or cancel orders in cases of suspected fraud, incorrect pricing or payment failure.


ARTICLE 6 – RIGHT TO CANCEL (COOLING-OFF PERIOD)

  1. Consumers have the statutory right to cancel their order within 14 days of receiving the goods, without giving any reason.

  2. To exercise the right to cancel, the consumer must notify Margery & Co. London in writing (by email).

  3. After cancellation notification, the consumer must return the goods within 14 days.

  4. The cooling-off period starts the day after the consumer or a nominated third party receives the goods.


ARTICLE 7 – CONSUMER OBLIGATIONS DURING THE COOLING-OFF PERIOD

  1. Products must be handled only to the extent necessary to establish their nature, characteristics and functioning, as would be permitted in a physical retail store.

  2. Any diminished value resulting from handling beyond what is necessary may be deducted from the refund.


ARTICLE 8 – RETURN PROCESS

  1. Consumers must notify Margery & Co. London by email at support@margeryandco.com before returning any items.

  2. Returns sent without prior approval may not be accepted or may be subject to processing delays.

  3. Approved returns must be sent to the return address provided by Margery & Co. London, which is located at our Asia warehouse outside the United Kingdom. The exact return address will be communicated by our customer support team after return approval.

  4. Returns must be shipped using a tracked shipping service. Proof of postage and tracking information must be retained.

  5. All return shipping costs, customs duties, import taxes (if applicable) and the risk of loss or damage during transit are the sole responsibility of the consumer, unless the return concerns a faulty or incorrect item.

  6. Margery & Co. London is not liable for any items lost, delayed or damaged during return transit.


ARTICLE 9 – REFUNDS

  1. Refunds are issued exclusively in the form of a single-use store credit voucher within 14 days after receipt and inspection of the returned goods.

  2. Store credit vouchers are non-transferable, non-refundable and cannot be exchanged for cash or refunded to the original payment method.

  3. Lost, unused or expired vouchers will not be reissued.


ARTICLE 10 – EXCLUSIONS FROM RETURN

Returns are not accepted for:

  • Sale or discounted items

  • Items returned after the return deadline

  • Worn, used or damaged items

  • Items without original tags or with scents, stains or signs of wear

  • Intimate apparel (including underwear and swimwear)

  • Jewellery (including personalised items)

  • Cosmetics and makeup


ARTICLE 11 – PRICING

  1. All prices are displayed in GBP (£) and include applicable UK VAT where required.

  2. Prices remain fixed during the offer period unless affected by statutory tax changes.


ARTICLE 12 – DELIVERY

  1. Orders are delivered to the address provided by the consumer during checkout.

  2. Orders are dispatched within 24 hours of confirmation, unless stated otherwise.

  3. The risk of loss or damage passes to the consumer upon delivery.


ARTICLE 13 – WARRANTY & STATUTORY RIGHTS

  1. Products must conform to the contract and be free from manufacturing defects.

  2. Nothing in these Terms affects the consumer’s statutory rights under the Consumer Rights Act 2015.

  3. Damage caused by misuse, negligence or normal wear and tear is excluded.


ARTICLE 14 – PAYMENT

  1. Payment must be made in full at the time of ordering.

  2. Secure payment methods include major credit and debit cards and PayPal.

  3. Orders will not be processed until payment is successfully completed.


ARTICLE 15 – COMPLAINTS

  1. Complaints must be submitted by email within a reasonable time after discovery of the issue.

  2. Margery & Co. London will respond within 14 days or inform the consumer if additional time is required.


ARTICLE 16 – GOVERNING LAW & JURISDICTION

  1. These Terms are governed by the laws of England and Wales.

  2. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
